APPLICABILITY OF GENERAL CONDITIONS

These general conditions of sale and warranty shall apply to the buying and selling relationship between PIMA velobike and a Customer. They are the integral part of the contract and are fully accepted by the Customer in the moment of the order confirmation.

TERMS OF AGREEMENT

Each order should be made with the order form available on the website www.cabbike.pl. Each order gets a unique number. Within 3 working days Customer will receive an e-mail confirming the order reception (and the order number) - from this moment on a contract between us shall be deemed to have been concluded. However, we reserve the right to reject the offer and not concluding a contract with a Customer without giving any reason

PRICES

Unless otherwise specified, in particular confirmed orders, prices include VAT. Price for wrapping is included in the price of your shipment. PIMA velobike reserves the right to change prices of its products without prior notification of this fact, however, this price changes does not apply to Customers who have previously received confirmation of the order.

TERMS OF PAYMENT

The Customer is required to pay the first tranche of the product, that is 30% of the whole price for the product, no later than 7 days from the date of the order made with the order form, otherwise the order is cancelled. After transferring the first tranche there is no possibility to withdraw from the contract, a withdrawal means the loss of the paid instalment and does not entitle the payer to a refund of the amount paid.

STAGES OF THE CONTRACT

The payment of the price will be made by the Customer without charging costs. The procedure applies to the contracts above 300 Euro.

1. The Customer specifies the product characteristics (colour, equipment, delivery distance etc.) and within 7 days the Customer pays 30% deposit of the product value.
2. We provide the photo report and the short reporting on what has been already done, having manufactured 30% of the product.
3. The Customer transfers a 35% deposit of the product value and we provide another photo report.
4. The Customer transfers a 35% deposit of the product value when we have manufactured 100% of the product wholly ready for supply to the Customer.

TRANSFER OF OWNERSHIP

Ownership of the goods is transferred to the Customer at the time of payment of the third tranche before sending the goods to the Customer.

GUARANTEE

Any complaint referring to technical specifications must be reported to PIMA velobike by a written notice, attaching appropriate documentation, including photographs, not later than 2 years after the delivery. The warranty does not apply to defects caused by incorrect product installation, by use which is improper use or diverse from the normal intended use of the product, by non-observance of the instructions for use and maintenance of the product, by its ordinary consumption. We are not responsible for any damage or malfunction and its negative impact on our products when using components or other parts indicated / selected by the Customer and recommended for use in the product ordered by the Customer.

DELIVERY TERMS

With reference to Incoterms, without the explicit written derogation resulting from the order confirmation or other document, the rendering of goods shall be "delivered at terminal" (DAT). The risks of loss and/or damage to goods are transferred from PIMA velobike to the Customer at the destination.
If the Customer or the carrier acting on his behalf doesn't take timely delivery of the goods, or if the Customer fails to give timely instructions for delivery, all risks and any additional charge that may weigh on the goods shall be charged to the Customer. Delivery costs are stated individually for each customer based on the distance of destination.

TRANSPORT - SHIPMENT

The condition of the goods will be carefully checked by PIMA velobike. All the ordered goods will be prepared, photographed and properly secured for shipment.
Any damage resulting from transportation or discrepancies as regards to the transport document, should be reported at the moment of the unloading via annotations on the document itself. Failing that, PIMA velobike will not replace delivered goods damaged because of the transport or discordant from the document.
